Terms of Service

These Terms of Service ("Terms") govern your use of JobCostingApp (the "Service"), operated by Job Costing App LLC ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

JobCostingApp is a software‑as‑a‑service platform for job costing, invoicing, labor and payroll tracking, subcontractor management, and related tools for contractors and service businesses.

3. Subscriptions, billing & trials

Who you are buying from. The Service is provided by Job Costing App LLC. Payments for subscriptions are processed by Stripe, which acts as the merchant of record and seller of record for the subscription transaction. This means Stripe is the party that sells you the subscription, collects payment, issues your receipt, and determines, collects and remits any sales, use or value added tax that applies to it. Your card or bank statement may show Stripe rather than JobCostingApp.

Prices and tax. Prices shown on our website and in the Service are exclusive of tax unless stated otherwise. Any applicable tax is calculated and added by Stripe at checkout, based on your billing address, and is shown before you confirm. If you are exempt from tax, or you are purchasing on behalf of a business with a valid exemption or registration number, provide it to Stripe at checkout.

Your agreement with us, and with Stripe. These Terms govern your use of the Service and your relationship with Job Costing App LLC. Your payment transaction is additionally subject to Stripe’s own terms, which you accept at checkout. Questions about the Service, your account or your data go to us. Questions about a charge, a receipt, a refund of a charge, or tax on a charge go to Stripe — and we will help you reach them.

What your membership includes. Your subscription fee covers use of the platform (the Service) together with the product support described in section 4.

Plan limits. Each plan includes a set number of administrator seats and a set number of worker accounts. The limits for your plan are shown on the pricing page and on your in-app billing page. If you need more, you can upgrade at any time.

Automatic renewal and cancellation. Paid plans renew automatically at the end of each billing period — monthly or annually, as you chose at signup — and your payment method is charged the then-current price for that plan, until you cancel. We disclose the renewal terms, the amount and the frequency before you subscribe, and we ask for your separate agreement to them.

How to cancel. You can cancel at any time, without calling or emailing anyone: sign in, go to Subscription from the menu, and choose “Manage or cancel my subscription”. You may also cancel by emailing support@jobcostingapp.com from the email address on your account, and we will process it. Cancellation stops all future charges and takes effect at the end of the period you have already paid for; you keep access until then. Cancelling your subscription does not delete your data — see the Account & Data Deletion page.

Reminders we send. We email you before your free trial converts to a paid subscription, and at least 30 days before each annual renewal. We are not required to remind you before each monthly renewal and generally will not, but you can see your next charge date at any time on your billing page.

Free trials. Free trials last 14 days. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged.

Price changes. We may change the price of a plan. If we do:

Refunds. Fees are non-refundable except where required by law or where these Terms provide otherwise. Because we offer a 14-day free trial, you can evaluate the Service before you are charged. Where a refund is due, it is processed by Stripe.

5. Your data & ownership

You own the business data you enter. You grant us a limited license to host and process it solely to provide the Service. We do not sell your data. You can export your data and request deletion as described in our Privacy Policy.

6. Acceptable use

You agree not to misuse the Service, including: violating laws; uploading malware; attempting to breach security; reverse‑engineering; reselling the Service without authorization; or using it to store unlawful content.

What you upload. You are responsible for the documents, photographs and information you put into the Service. By uploading, you confirm that you have the right to do so and that doing so does not infringe anyone’s rights or breach any duty of confidence you owe. Do not upload government identification numbers, financial account numbers, health information, biometric information, or information about anyone under 18. The Service is not designed to hold information of those kinds and we do not apply the additional protections that such information requires.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by us and protected by law. These Terms do not transfer any ownership of the Service to you.

8. Documents generated

Estimates, contracts, invoices, payroll and subcontractor agreements generated by the Service are provided as convenience templates. You are responsible for reviewing them and ensuring they meet your legal and business needs. They are not legal advice.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that the Service will be uninterrupted or error‑free. Financial figures and margins are tools to assist your decisions, not professional financial advice.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your data, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or for non‑payment. Upon termination, your data is handled per our Privacy Policy.

13. Governing law, venue, and disputes

13.1 Governing law. These Terms and any dispute arising out of or relating to them or to the Service are governed by the laws of the State of New Mexico, without regard to its conflict of law principles and without regard to the United Nations Convention on Contracts for the International Sale of Goods.

13.2 Venue. The exclusive venue for any action arising out of or relating to these Terms or the Service is the state and federal courts located in Valencia County, New Mexico. You and we each consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum. Either party may bring an individual action in small claims court in the county where the defendant resides or does business, for any claim within that court’s jurisdiction.

13.3 Before you file. If a dispute arises, you agree to contact us first at support@jobcostingapp.com with a written description of the problem and what you want, and to give us thirty (30) days to resolve it. We agree to do the same before we file against you. Nothing in this section prevents either party from seeking urgent relief from a court, or from taking any step needed to meet a deadline set by law.

14. Changes to these Terms

We may update these Terms. For changes that are not material — corrections, clarifications, new features — we will post the updated Terms with a new effective date.

For material changes — including changes to price, to plan limits, or that reduce the Service in a way that matters to you — we will give you at least 30 days’ notice by email to the address on your account, and the change will take effect at your next renewal, not immediately. If you do not accept a material change, you may cancel before it takes effect and you will not be charged for the renewal. If a material change takes effect mid-term because we are required to make it, and you cancel within 30 days of the notice, we will refund the unused portion of what you have paid.

Continuing to use the Service after a change takes effect means you accept it.
